Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nomee web application and related services (the "Service") operated by Nomee ("Nomee," "we," "us," or "our"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Nomee provides digital profile and link-sharing tools for individuals and organizations, including public profile pages, QR codes, NFC tag writing, invite links, company administration features, and optional AI-assisted chat on profiles.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that organization to these Terms.

3. Your Account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate registration information and keep it up to date.
  • You must notify us promptly if you suspect unauthorized access to your account.

We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. Your Content and Public Profiles

You retain ownership of content you submit to the Service ("User Content"), including profile information, images, links, and messages you enable through optional features.

By using the Service, you grant Nomee a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your User Content solely as needed to operate and improve the Service — for example, to render your public profile, generate shareable links and QR codes, or deliver AI chat responses where enabled.

Public profiles: Information you add to an active profile may be publicly visible to anyone with your profile URL. You are solely responsible for what you choose to publish, including contact details, social links, and images.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful, fraudulent, or harmful purposes
  • Upload content that infringes intellectual property or privacy rights of others
  • Harass, impersonate, or mislead others
  • Distribute malware, spam, or attempt to disrupt the Service
  • Scrape, reverse engineer, or abuse APIs except as permitted by us
  • Circumvent access controls or security measures

We may remove content or restrict access that we reasonably believe violates these Terms or applicable law.

6. Company Accounts

If your organization provisions accounts through Nomee's company features, your company administrator may create, manage, and deactivate member accounts, set branding, and restrict available platform options. Company administrators are responsible for their members' compliance with these Terms.

7. Third-Party Services

The Service integrates with third parties such as Google Sign-In, cloud hosting and storage providers, AI services, and external platforms you link to (WhatsApp, LinkedIn, etc.). Your use of those services is subject to their own terms and policies. Nomee is not responsible for third-party services.

8. Intellectual Property

The Service, including its design, software, branding, and documentation (excluding User Content), is owned by Nomee and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service except as expressly permitted.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMEE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.

11. Indemnification

You agree to indemnify and hold harmless Nomee from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, but sections that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

Nomee is operated from Malaysia and available to users worldwide. These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles. You agree that the courts of Malaysia shall have jurisdiction over disputes arising from these Terms, except where mandatory consumer protection laws in your country require otherwise.
